Lottery tickets are legal in Peru under comprehensive gambling regulations enacted by the Ministry of Foreign Trade and Tourism known as MINCETUR. In 2023, Peru introduced comprehensive new regulations for gaming, including online gambling, marking a significant shift in the landscape for both operators and players, with this regulatory overhaul encapsulated in Supreme Decree 005-2023-MINCETUR (1). Following Colombia and Argentina, Peru became the third South American country to regulate online gambling, with regulations coming into force on February 9, 2024.
MINCETUR is the executive body responsible for steering Peru's gambling industry at the national level, assuming direct responsibility for licensing, supervising, and enforcing online gambling and remote sports betting since the passage of Law No. 31557 in 2022 (2). The ministry works in close coordination with sub-agencies such as the Dirección General de Juegos de Casino y Máquinas Tragamonedas, tasked with granting licences, overseeing compliance, managing enforcement actions, and authorising payment blocks and IP restrictions on illegal operators. Within the first 30 days of this law being enforced, MINCETUR received 145 applications from operators seeking licenses to join the newly regulated market.

The newly implemented regulations are projected to generate approximately S/162 million annually in tax revenue, strategically invested in tourism, tourist infrastructure, sports, and mental health programs (1). Operators must obtain a six-year, non-transferable license from MINCETUR to offer sports betting and online gambling services in Peru, with licensed platforms registered and approved with compliance certificates from authorized laboratories. Operators who fail to comply with the regulations face severe consequences including fines of up to S/990,000 and key officials can receive prison sentences of up to four years.
