In Botswana, the Gambling Act of 2012 provides the legal framework for all forms of gambling, including lotteries. Under Section 2 of the Act, a “lottery” is defined as making or accepting bets on the outcome of any event, and such activities are only lawful when conducted under a licence issued by the Gambling Authority (1).
The Gambling Authority was established to regulate and control all gambling activities in the country. It has the exclusive power to grant, suspend, or revoke licences for lotteries, ensuring that only authorised operators may offer lottery tickets to the public (2).
"To regulate and control all gambling establishments and activities in Botswana; to issue, suspend and revoke licences; to issue and control the licence to operate the National Lottery; and to evaluate and disburse funds from the National Lottery Distribution Fund."
As a result, it is legal for individuals aged 18 and over to purchase lottery tickets, provided they buy from a licensed retailer or operator approved by the Gambling Authority. Unlicensed lotteries or private schemes that do not hold a valid licence remain unlawful under the Act (1).
